Delaware marijuana regulators made public the first draft of proposed industry rules for the upcoming recreational cannabis market, with finalized rules expected by July 11. Sales could begin sometime next year.
The rules released by the Delaware Office of the Marijuana Commissioner cover the intended business licensing process, product packaging and labeling, and product safety testing, Delaware Public Media reported. For instance, recreational marijuana goods, such as flower, will have to come prepackaged, as opposed to having openable mason jars full of cannabis flower for customers to smell prior to purchasing.
Commissioner Rob Coupe told the news outlet that if all goes well following a public comment period that lasts until June 3, the agency should be able to start accepting retail permit applications next March.
The OMC also revealed that it will be hosting four social equity workshops for entrepreneurs in June to help educate applicants on the complicated ins and outs of the cannabis trade, such as how to obtain banking services, deal with tax obligations, and more, Delaware Public Media reported.
Social equity marijuana permits will be available to applicants with cannabis-related criminal records or those who have lived in areas disproportionately impacted by prohibition for at least five years out of the last decade. The specific areas that will qualify applicants, through a map of disproportionately affected areas, is still being compiled by the OMC.
Although the Delaware Legislature legalized recreational marijuana last year, the state has been slow to get the new market off the ground, and only 125 business licenses are expected to be awarded by regulators. The first permits are required by state law to be issued by this coming August.
Once the Delaware market is operational, it’ll mark the near-complete legalization of cannabis in the Northeastern U.S., with New Hampshire and Pennsylvania remaining as the only states in the region without adult-use markets. The two states do have medical-only markets.
